Overview

Paul Rose is a Chartered Arbitrator, a Chartered Surveyor and an Accredited Mediator with Clerksroom the Chartered Institute of Arbitrators and RICS. Paul has mediated some 150 mediations and he has over some 51 years’ broad experience as a Chartered Surveyor both in private practice and in the corporate sector.

 

Paul is a Fellow of the Chartered Institute of Arbitrators and a member of the President’s Panel of Arbitrators at the Chartered Institute of Arbitrators and CIArb Disputes Service panel – property. He undertakes arbitrations under the Pubs Code and the Commercial Rent (Coronavirus) Act 2022. He is also a member of the President’s Panel of Mediators at the Chartered Institute of Arbitrators as well as RICS Neighbourhood Disputes Panel; and is one of the few people dual qualified as a commercial Mediator and an Arbitrator. Paul is also a member of the Advisory Board of the Dubai Mediation Centre.

 

Paul is also a member of the Panel of Arbitrators of the London Court of International Arbitration and the panel of Arbitrators and Mediators of the Kuala Lumpur Regional Centre for Arbitration and the Saudi Centre for Commercial Arbitration.

 

He is a member of the panel of Mediators at the Dubai Mediation Centre and is a member of the RICS.

Experience:

48 years in private, corporate and local government practice. Organisations: Garrard Smith & Partners, Peter Symmons & Co. Napier Bentley, London Boroughs of Hammersmith and Fulham and Haringey, Old Mutual Properties Johannesburg South Africa. Principal of Robert Crawford Ltd.

Surveying:

Surveying experience includes office and retail agency, valuations for building society and bank mortgages, homebuyer reports, right to buy legislation, improvements, compulsory purchase, commercial rent reviews of shops, offices and industrial properties, commercial lease renewals of shops, offices and industrial properties, capital and rental valuations of office blocks shops and industrial properties, enfranchisement of houses, and lease extensions. Expert witness work in the Courts including Court of Appeal. Rent reviews proceeding to expert determinations and arbitration.

Arbitration:

Arbitration experience comprises 79 appointments as sole arbitrator with amounts up to £12 million GBP. Subject areas include ABTA travel cases, neighbour dispute, commercial property market rent reviews, commercial development site ground rent review, challenges to jurisdiction, Pubs Code compliant lease terms, partnership, development value, commercial and residential dilapidations, water moorings rent, building contracts, commercial service charges, negligent surveys, aviation insurance. 
International Arbitration cases: Hotel corporate share acquisition Tanzania; Commission dispute - energy contract Turkey.

Domestic cases: Family law; building contracts, residential service charges; commercial service charges; easements; professional fees, information technology; boundaries; neighbourhood disturbance; costs; alleged negligent property conveyances, alleged negligent surveys and valuations, contract misrepresentation, sales of land, dilapidations; damages for breaches of covenant; construction, compulsory purchase compensation.

International experience: An ICSID dispute – Construction of University facilities. ($70 million) in Africa; Multi – building construction dispute in Malaysia ($40 million).
