ArbDB Chambers Member, Mark Appel, has been training new mediators in Saudi Arabia. Training was provided in cooperation with the International Centre for Dispute Resolution, under the auspices of the Saudi Center for Commercial Arbitration (SCCA).   SCCA has made significant investments in the training of arbitrators and mediators in the Kingdom. Lasting three days, this well-received course was provided in Arabic and English, and was completed by 30 Saudi lawyers.

This is an interesting development for ArbDB Chambers, in view of the further professionalisation of ADR since the launch of the SCCA in October 2016, recent developments and the opportunities that these present.

ArbDB Chambers already has an office in the region in Dubai, where Member, George Grant, is based and Members Michael Cover, John Wright, Paul Rose and George recently attended Dubai Arbitration Week, together with our Clerk, Martin Poulter.”

This Evening Seminar at the Kuala Lumpur Regional Centre for Arbitration will look at and define the existing models and then look at Dispute Boards, now a familiar feature of major projects funded by the Multilateral Development Banks, and move through existing although tricky concepts, such as to Arb-Med and Med-Arb, into the new world of Conflict Avoidance Panels, as exemplified by the Transport for London initiative and the new UK initiative on IT Contracts.

The Evening Seminar will be moderated by KLRCA's Director, Datuk Professor Sundra Rajoo and the speakers John Wright and Michael Cover are both be experienced third party neutrals, whose expertise spans the various forms of dispute resolution to be covered. John and Michael are both Members and Directors of ArbDB Chambers, comprising arbitrators, mediators and dispute board members, having offices in London, Dubai and in the Kuala Lumpur Regional Centre for Arbitration. The evening will be rounded off by networking refreshments at the KLRCA.

ArbDB Chambers Members, Peter McQueen and Michael Cover, participated in and made substantial contributions to ICMA XX in Copenhagen, which was organised with the Danish Institute of Arbitration.

Peter McQueen was the Chair of the Topics and Agenda Committee, which had put together a great programme of 120 presentations over the four days of the Congress covering a wide range of hot topics international maritime law and arbitration. The Congress was attended by some 250 delegates from 35 different countries, many of whom being leading international maritime arbitrators. The feedback on the congress has been very positive.

Michael spoke at one of the breakout sessions on the Monday afternoon, entitled 'Dispute Resolution Clauses', which was moderated by Datuk Professor Sundra Rajoo, the Director of the Kuala Lumpur Regional Centre for Arbitration. Michael's topic was 'Combined Dispute Resolution Processes- trends and challenges- heresy or what the market might want?'

 

The Paper looked at the growing respectability of hybrid dispute resolution processes and in particular, conflict avoidance panels.

ArbDB Chambers Members, Tony Marks and Paul Rose, both participated in the CIArb Mediation Symposium 2017.

Paul Rose co-chaired the CIArb Mediation Symposium 2017 “Mediation in a Changing World – Adding Real Value and Understanding and the Impact of Bias” held at Ashursts, Broadwalk House, 5 Appold Street, London EC2A 2AG on Wednesday 27 September 2017.

For the afternoon session, Paul introduced his co-speakers John Howell OBE MP, Chair of the All-Party Parliamentary on Alternative Dispute Resolution, and Anne-Marie Blaney, Solicitor Mediator and past Chair of the Chartered Institute of Arbitrators, Irish Branch.

The first of those sessions was entitled “A Route Map for Practical Negotiation with a Focus on the Economic Value of Mediation”. John Howell spoke on the changing culture in the UK to accept ADR and also spoke about Network Rail having put out its customer complaints to ADR and that it was looking at ADR in the planning arena.

Having heard from John Sturrock QC and Kenneth Cloke and Charlie Woods, the Executive Director of the Scottish Universities Institute, in the morning on Cognitive Bias, Paul then gave a talk on game theory used in mediation with the emphasis on zero-sum and non-zero-sum games, giving examples of where cooperation and overlapping interests relate and developing the theme of trust and communication.

Paul then introduced Anne-Marie Blaney whose talk focussed on corporate ethics and included the social ecosystems of CSR and the sectors of society including ethical guidelines standards, the working party of the Harvard-Kennedy school and also introduced the UN Guiding Principles on Business and Human Rights endorsed in UN Resolution 17/4 and called UNDGP’s.  She also referred to the UN Global Compact, which is on ethical standards relating to child labour and inhumane conditions in the workplace, and finally commented upon the business and commercial mediation pilot scheme.

After the teabreak, Paul introduced both workshop sessions with scenarios based on two very different mediations which Paul had undertaken as sub-mediator.

At the end of the Symposium, Paul summarised the day’s proceedings and, having thanked all the speakers and Ashursts as hosts, invited the attendees to a drinks reception.

ArbDB Chambers Members, Mark Appel, Wolf von Kumberg and, more recently, Michael Cover, have all been part of the IMI Investor-State Mediation Task Force. Mark is the Chair of this Task Force, which is made up of leading neutrals, government representatives and academics from around the world.

The Task Force has developed the Response to ICSID on its Invitation to File Suggestions for Rule Amendments and a link is included in this News Item. The main recommendations in the Response are that the existing settlement component in the ICSID Arbitration Rules be further developed with specific reference to mediation, that the Secretariat disseminate mediation information, that, in due course, ICSID considers a standalone set of Mediation Rules and that ICISID offer client and mediator education and training.
